Legal Disclaimer
PLEASE READ THIS CAREFULLY - THIS AFFECTS YOUR LEGAL RIGHTS
In exchange for participation in the activity of online coaching organized by Black Bear Fitness, LLC and/or use of the property, facilities and services of Black Bear Fitness, LLC, I (the Client) agree for myself to the following:
1. AGREEMENT TO FOLLOW DIRECTIONS. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Black Bear Fitness, LLC, or the employees, representatives or agents of Black Bear Fitness, LLC.
2. ASSUMPTION OF THE RISKS AND RELEASE. I recognize that there are certain inherent risks associated with the above described activity and I assume full responsibility for personal injury to myself and further release and discharge Black Bear Fitness, LLC for injury, loss or damage arising out of my use of or presence upon the facilities of Black Bear Fitness, LLC, whether caused by the fault of myself, Black Bear Fitness, LLC, or other third parties.
3. INDEMNIFICATION. I agree to indemnify and defend Black Bear Fitness, LLC against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my use of or presence upon the facilities of Black Bear Fitness, LLC.
4. FEES. I agree to pay for all damages to the facilities of Black Bear Fitness, LLC caused by any negligent, reckless, or willful actions by me.
5. CONSENT. I consent to the participation in the activity of online coaching, and agree to all of the terms and conditions of this Agreement.
6. APPLICABLE LAW. Any legal or equitable claim that may arise from participation in the above shall be resolved under Pennsylvania law.
7. NO DURESS. I agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire.
8. ENTIRE AGREEMENT. This Agreement constitutes the entire agreement of the parties with regard to the subject matter hereof, and supersedes all previous written or oral representations, agreements and understandings between the parties, whether expressed or implied
9. ENFORECEABILITY. The invalidity or unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or of any other applications of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be a part of this Agreement.
10. FREE WILL. I agree and acknowledge that I was not persuaded by Black Bear Fitness, LLC into the services provided. I certify that I approached Black Bear Fitness, LLC under my own free will.
11. COUNTERPARTS. This Agreement may be executed in two or more counterparts, each of which shall be deemed to be an original but all of which, taken together, constitute one and the same agreement.
I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I FURTHER UNDERSTAND THAT BY PURCHASING SERVICES PROVIDED BY Black Bear Fitness, LLC, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.
